1. ACCEPTANCE OF TERMS

By accessing or using the Coffee Friends 55 application ("the App"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, you may not use the App.

2. ELIGIBILITY AND AGE REQUIREMENT

Coffee Friends 55 is a dedicated community for older adults. You must be at least 55 years of age to register and use the App. By accessing the App, you represent and warrant that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to use an Alias that is appropriate for a respectful community setting.

3. THE SERVICE

Coffee Friends 55 provides a platform for individuals to connect through various social rooms and one-on-one connections. The service is strictly designed to foster casual conversation, build friendships, and combat loneliness in a safe environment.

4. COMMUNITY GUIDELINES & ACCEPTABLE USE

To maintain a safe and welcoming environment, you agree NOT to:

• Use the App to harass, abuse, defame, or intimidate other members.
• Share illegal, explicit, or highly offensive content.
• Use the App for commercial spam, unauthorized advertising, or soliciting.
• Impersonate any other person or entity.

5. MODERATION AND TERMINATION

Coffee Friends 55 is actively moderated. Designated "Room Managers" and App Administrators possess the right to remove ("Kick") users from chat rooms for violating community guidelines. Furthermore, Coffee Friends 55 reserves the right to suspend or permanently terminate your account without notice for severe violations of this Agreement. To ensure active community participation, accounts that remain inactive for a period of 14 days may forfeit their spot to accommodate new members.

6. USER-GENERATED CONTENT & DATA PRIVACY

You retain ownership of the messages, voice notes, and images you post. By posting content, you grant Coffee Friends 55 a non-exclusive, royalty-free license to display that content within the App.

Data Retention: For your privacy and security, and to minimize server load, all file attachments and voice messages are automatically and permanently deleted from our servers after 72 hours.

7. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Coffee Friends 55 makes no warranties regarding the uptime, reliability, or accuracy of the App. To the maximum extent permitted by law, Coffee Friends 55 and its creators shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the App.

8. DISCLAIMER OF MEDICAL ADVICE AND EMERGENCY SERVICES

At Coffee Friends 55, we love the science of connection. We share statistics from the CDC and the Surgeon General because we believe staying social is vital for a happy life. However, Coffee Friends 55 is a community, not a clinic. The App is NOT a provider of medical advice, emergency services, or professional counseling.

• We are friends, not physicians. Nothing on this website or in our chat rooms constitutes medical advice or professional treatment.
• Consult the pros. If you are experiencing memory loss, depression, or physical symptoms, please seek guidance from a licensed healthcare provider. If you are experiencing a medical or mental health emergency, dial 911 or contact local emergency services immediately.
• Chat responsibly. We encourage you to share your life experiences with friends here, but please do not seek, give, or rely on medical diagnoses or professional counseling in our chat rooms.

9. DISPUTE RESOLUTION AND MANDATORY ARBITRATION

Please read this section carefully, as it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by mandatory, binding arbitration in Williamson County, Tennessee, before one arbitrator. The arbitration shall be administered by **JAMS (Judicial Arbitration and Mediation Services)** pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. You waive any right to bring or participate in a class action lawsuit against Coffee Friends 55.
